Not because anyone acts in bad faith. Because a plant contract is written by people who build plants, and read by people who operate them.
Tenders declare a functional, performance-based scope and at the same time fix component dimensions in the annexes. Conformity then has to be assessed on two levels – guaranteed output values and prescribed minimum design values. Only one of them is usually checked.
When two guaranteed values carry equal weight in the evaluation but very different penalty rates, bidders quote generously where a miss is cheap and cautiously where it hurts. The offered figures have to be read against the concept behind them, not against each other.
General contractor, subcontractors and external experts each deliver their defined scope. Items that fall between those scopes – earthing and bonding, lightning protection, zone consistency between the explosion protection document and the equipment list – are ordered by no one and surface at the authority hearing.
